BY THE COUNCIL CLEGG, LUDWIG, MCLEAN, SANCHEZ, THOMSON AND WOODINGS
AN ORDINANCE AMENDING BOISE CITY CODE TITLE 6, CHAPTER 5, TO ADD A NEW SECTION 2 GOVERNING TRAFFIC IN CENTER LANES; WAIVING THE READING RULES; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, through the Sterling Codification of the Boise City Code, the code section regarding “traffic lanes” was removed; and
WHEREAS, the Boise Police Department historically used this City Code section because there is no comparable Idaho Code provision.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF BOISE CITY, IDAHO:
Section 1: That existing Boise City Code Title 6, Chapter 5 be, and hereby is, amended to add a Section 2 to read as follows:
Section 6-5-2 CENTER LANES
Upon a roadway where traffic is permitted to move in both directions, whenever the center lane of said roadway is bounded by solid lines, vehicles shall travel upon said center lane only for the purposes of turning to the left or entering a designated traffic lane after completion of a left turn. Vehicles shall not use said center lane as a passing lane nor shall any vehicle travel upon said center lane for a distance of more than one hundred feet (100') prior to turning to the left or following completion of a left.
Section 2. That pursuant to the affirmative vote of one-half (1/2) plus one (1) of the members of the full Council, the rule requiring two (2) separate readings by title and one (1) reading in full be, and the same is hereby, dispensed with, and accordingly, this Ordinance shall be in full force and effect immediately upon its passage, approval, and publication in the official newspaper of the City of Boise.
