BY THE COUNCIL CLEGG, LUDWIG, MCLEAN, SANCHEZ, THOMSON AND WOODINGS
AN ORDINANCE AMENDING BOISE CITY CODE TITLE 6, CHAPTER 13, BICYCLES, E-BIKES, AND E-SCOOTERS TO ADD A NEW SECTION 19 THAT PROHIBITS DEFACING PROPERTY BY E-BIKE OR E-SCOOTER TIRES; RENUMBERING THE CURRENT BOISE CITY CODE TITLE 6, CHAPTER 13, SECTION 19 AND ALL SUBSEQUENT SECTIONS; PROVIDING FOR A WAIVER OF THE READING RULES; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF BOISE CITY, IDAHO:
Section 1. That existing Boise City Code Title 6, Chapter 13, shall be, and hereby is, amended to add a new section 19, that reads as follows:
6-13-19: DEFACING PUBLIC OR PRIVATE PROPERTY:
A person who purposely or knowingly defaces or otherwise damages public or private property open to the public by creating E-bike or E-scooter tire markings thereon, shall be guilty of defacing public or private property, a misdemeanor and, upon conviction subject to the penalty as provided in section 1-4-1 of this Code.
Section 2. That existing Boise City Code Title 6, Chapter 13, Section 19 and all the subsequent sections, shall be, and hereby are, accordingly renumbered.
Section 3. Pursuant to an affirmative vote of one-half (1/2) plus one (1) of the members of the full Council, the rule requiring two (2) separate readings by title and one (1) reading in full be, and the same is hereby, dispensed with and accordingly, this Ordinance is passed and adopted.
Section 4. That this Ordinance shall be in full force and effect after its passage, approval, and publication in the official newspaper of the City of Boise.
