Sidewalks

7-5-1: Obstructing Sidewalks


It shall be unlawful for any person to obstruct, injure or impair any of the sidewalks, streets or alleys in the City. This section shall not prohibit the operation of a sidewalk cafe pursuant to a permit issued by the City Clerk. (Ord. 19-19, 5-21-2019)

7-5-2: Marking On Sidewalks


It shall be unlawful for any person to post, paste, paint, print, mark, stencil or nail any handbill, poster, advertisement or notice of any kind upon any curbing, sidewalk, fire alarm box or fire hydrant within the City. (1952 Code § 9-08-02)

7-5-3: Sweepings On Sidewalks


It shall be unlawful for any person in charge of any place or premises to permit any dust, dirt or refuse matter therefrom to be thrown, placed or swept upon any sidewalk or street; provided, that in case of accident or necessity while properly using the street, such person shall not be liable if he shall immediately clean up the dirt, refuse or litter caused thereby, and on his failure to do so the same may be done by the City at his cost and expense, together with the costs of the action to recover the same. 7-5-4: Cleaning Required


Every owner or occupant of any building or vacant lot and every person having the charge of any church, jail or public building in this City abutting upon any paved street shall daily (Sundays and holidays excepted) or more often if required, sweep up and keep clean the sidewalk in front of such premises and shall remove the dirt and sweepings therefrom in a manner so as not to litter either the street or sidewalk and must do this between the hours of four o'clock (4:00) A.M. and nine o'clock (9:00) A.M. on each day. It shall be unlawful for any person to neglect or refuse to sweep and keep clean such portion of the sidewalk as is in front of his premises and to comply with the provisions of this section. 7-5-5: Removing Snow Required


Every owner of any building or vacant lot, and every person having the charge of any church, jail or public building in this City shall, during the time snow shall be on the ground, by nine o'clock (9:00) A.M. every morning, when necessary, clear the sidewalks and gutters in front of his property from snow, and keep conveniently free therefrom during the day, so as to allow citizens to use the sidewalks in an easy, safe and commodious manner. It shall be unlawful for any person to neglect or refuse to comply with the provisions of this section. (1952 Code § 9-08-07; amd. 2019 Code)

7-5-6: Draining Sidewalks


Any person having charge of or the care of any lot bordering on or adjacent to any sidewalk shall keep such sidewalk drained so as not to permit or allow water to stand thereon, and no person shall leave or allow any water hose to remain on such sidewalk during the nighttime. It shall be unlawful for any person to violate the provisions of this section. (1952 Code § 9-08-08; amd. 2019 Code)

7-5-7: Penalty


Any person violating any provision of this chapter shall be guilty of a misdemeanor and, upon conviction, subject to penalty as provided in section 1-4-1 of this Code. (2019 Code)
