ARTICLE A - Police Department

There is hereby created an administrative department of the City to be known as the Police Department. (2019 Code)

1-10A-2: Chief Of Police


The Director of the Police Department shall be the Chief of Police, who shall superintend, direct and manage the department and all assigned and employed departmental officers, assistants and employees. The Chief of Police shall be appointed by the Mayor and confirmed by the City Council. (Ord. 24-16, 8-9-2016; amd. 2019 Code)

ARTICLE B - Fire Department

1-10B-1: Created


There is hereby established and created an administrative department of the City to be known as the Fire Department. (1952 Code § 3-11-01)

1-10B-2: Director Of Department


The Director of the Fire Department shall be the Fire Chief, who shall superintend, direct and manage the department and all officers, assistants and employees assigned to and employed for the department and its various divisions. The Fire Chief shall be appointed by the Mayor by and with the advice and consent of the City Council. (1952 Code § 3-11-03)

1-10B-4: Recognition Of Local 149 Of International Association Of Firefighters


In the event laws of the State are amended in such a manner as to remove the obligation to bargain collectively with firefighters of the Fire Department, the City will nevertheless continue to bargain with Local 149 of the International Association of Firefighters as to wages, rates of pay, working conditions and all other terms and conditions of employment until such time as said association is no longer recognized by the City firefighters as their authorized bargaining agent. The City's continuing bargaining obligation in such event shall be identical to that set forth in Idaho Code title 44, chapter 18, prior to such amendment, except as modified by any provisions of an applicable collective labor agreement between the City and Local 149. ARTICLE C - Legal Department

There is hereby created an administrative department of the City to be known as the Office of the City Attorney, which may also be known as the Legal Department. (2019 Code)

1-10C-2: Director Of Legal Department


There is hereby created the Office of the City Attorney, who shall superintend, direct and manage the department and all officers, Deputy City Attorneys, assistants and employees assigned to and employed for the department and its various divisions. The City Attorney shall be the Chief Legal Advisor of the City and shall exercise all powers and duties necessary and incidental to those authorized by the Constitution, Federal law, State Code, this Code and policies and procedures set forth by the Mayor and City Council. ARTICLE D - Department Of Aviation

1-10D-1: Created


There is hereby created an administrative department of the City to be known as the Department of Aviation. (1952 Code § 3-02-01)

1-10D-2: Director Of Department


There is hereby created the Office of Director of Aviation, who shall manage, supervise, superintend and direct the Department of Aviation and all officers, assistants and employees assigned to and employed for the department and its various divisions. The Director of Aviation is commonly referred to as the Airport Director or Airport Administrator, and these terms shall be synonymous with the Director of Aviation. The Director shall be appointed by the Mayor with the advice and consent of the City Council. (1952 Code § 3-02-02; amd. 2019 Code)

ARTICLE E - Department Of Parks And Recreation

1-10E-1: Creation


There is hereby created an administrative department within the City to be known as the Boise City Department of Parks and Recreation. (Ord. 42-18, 9-25-2018)

1-10E-2: Director


There is hereby established the Office of Director, who shall superintend, direct and manage the department in accordance with the directions, orders, rules and regulations adopted and promulgated by the Parks and Recreation Commission and, as may be required by ordinance, ratified, adopted and approved by the City Council and Mayor. The said Director shall be appointed by the Mayor by and with the advice and consent of the Council. (Ord. 42-18, 9-25-2018)

The Director shall exercise all powers and duties necessary and incidental to those authorized by the Constitution, Federal law, State Code, this Code and policies and procedures set forth by the Mayor and City Council. (2019 Code)

ARTICLE F - Department Of Public Works

1-10F-1: Created


There is hereby created an administrative department of the City to be known as the Department of Public Works. (Ord. 39-16, 10-25-2016)

1-10F-2: Director Of Public Works


There is hereby created the Office of Director of Public Works, who shall superintend, direct and manage the department and all officers, assistants and employees assigned to and employed for the department and its various divisions. The Director shall be appointed by the Mayor with the consent of the City Council. (Ord. 39-16, 10-25-2016)

1-10F-3: Powers And Duties


The Director of Public Works, in addition to those necessarily or fairly implied in or incidental to or those essential to the powers, duties and functions hereinafter expressly delegated and specified shall supervise, and be in charge of:


A. The planning, design, construction, management, maintenance and operation of the sewage collection and treatment system.


B. Planning, design, construction, management, maintenance and operation of the geothermal system.


C. Planning, design, construction, management, maintenance and operation of the Municipal irrigation system.


D. Planning, design, construction, management, maintenance and operation of the public streetlight system.


E. Planning, design, construction, maintenance and operation of the drainage and stormwater systems not the responsibility of other entities.


F. Planning and management of solid waste service, including, but not limited to, waste reduction programs and recycling.


G. Planning for, and protection of, groundwater quality.


H. Planning for, and protection of, air quality.


I. Providing technical engineering, inspection and project management support services to other City departments.


J. With concurrence of the Mayor and Council, establish fees necessary to carry out the duties of the department.


K. Billing and collection of City utility fees and charges.


L. Maintaining and repairing assigned City facilities.


M. Providing internal security assistance, including operation and maintenance of the security system.


N. Appointment of a City Engineer who shall be a professional engineer licensed by the State.


O. Assume and perform such other duties, functions and services as may be required by ordinance or as assigned by the Council or Mayor. (Ord. 39-16, 10-25-2016)

There is hereby created the Office of the Director of Planning and Development Services, who shall superintend, direct and manage the department and all officers, assistants and employees assigned to and employed for the department and its various divisions. ARTICLE H - Department Of Finance And Administration

There is hereby created an administrative department of the City to be known as the Department of Finance and Administration. (1952 Code § 3-06-01)

1-10H-2: Director Of Department


There is hereby created the Office of Director of Finance and Administration, who shall superintend, direct and manage the department and all officers, assistants and employees assigned to and employed for the department and its various divisions. The Director shall be appointed by the Mayor by and with the advice and consent of the Council. The Director shall serve as City Clerk ex officio and Treasurer ex officio. The Director of Finance and Administration shall exercise all powers and duties necessary and incidental to those authorized by the Constitution, Federal law, State Code, this Code and policies and procedures set forth by the Mayor and City Council. ARTICLE I - Department Of Information Technology

There is hereby created an administrative department of the City to be known as the Department of Information Technology. (1952 Code § 3-07-01)

1-10I-2: Director Of Department


There is hereby created the Office of the Director of the Information Technology Department, who shall be known as the Chief Information Officer (CIO), and who shall superintend, direct and manage the department and all officers, assistants and employees assigned to and employed for the department and its various divisions. The CIO shall be appointed by the Mayor by and with the advice and consent of the City Council. (1952 Code § 3-07-02; amd. 2019 Code)

ARTICLE J - Department Of Human Resources

There is hereby created the Office of the Director of Human Resources, who shall superintend, direct and manage the department and all officers, assistants and employees assigned to and employed for the department and its various divisions. 1-10J-4: Applicants For City Employment, City Volunteers; Criminal History Checks


A. Pursuant to Idaho Code section 67-3008, the City is authorized to perform and/or request criminal history checks of any applicant volunteer service or employment, including current employee transfers and promotions within the City. If a criminal history check is needed through the Federal Bureau of Investigation to screen an applicant or volunteer, the Department of Human Resources shall require each specified applicant or volunteer to be fingerprinted and shall forward the fingerprints through the Idaho Department of Law Enforcement to the FBI Identification Division for a criminal history check. Unless otherwise provided for by law, criminal history records shall not be disseminated to a private entity.


B. The Department of Human Resources shall develop guidelines for determining what positions for employment and volunteer service will require a background check and fingerprinting. The guidelines will include those factors reasonably related to the requirements of that position which may result in an applicant's disqualification for employment or volunteer service as a result of past criminal activities. 1-10J-5: Falsifying Examination; Punishment


It shall be unlawful and punishable as a misdemeanor for any person, officer or employee, by him/herself, or by any other person, or in cooperation with any other person, to defeat, deceive or obstruct any person in respect to his or her right to examination, or to corruptly or falsely mark, grade, estimate or report upon the examination or proper standing of any person examined, or to furnish to any person examined or to be examined, employed or promoted, any secret or special information for the purpose of either improving or injuring the prospects, chances or grade of any person examined or to be examined. No applicant for any examination shall make any false representation as to his or her identity or permit any fraud for the purpose of improving the prospects of examination; provided, the provisions of this section shall not apply to the holding or conducting of education courses or like training. Violation of this provision shall be a general misdemeanor and, upon conviction, subject to penalty as provided in section 1-4-1 of this title. (Ord. 24-16, 8-9-2016; amd. 2019 Code)

1-10J-6: Comprehensive Liability Plan


The Director of Human Resources or their designee shall oversee a comprehensive liability plan in compliance with Idaho Code. Additionally, with the concurrence of the City Attorney, the Director shall settle claims and lawsuits including, but not limited to: tort claims, sewer no-fault claims, workers' compensation, subrogation, excess insurance reimbursements, third party liens, or contribution or indemnity claims.
