Planning And Zoning Commission1

2-4-1: Created


There is hereby created a Planning and Zoning Commission for the City, which commission shall be known and designated as the Planning and Zoning Commission. (1952 Code § 2-06-01)

2-4-2: Clerk Or Secretary


The Planning and Zoning Commission shall have authority to designate a Clerk, who may be an officer or employee of the City, and who shall act as such Clerk or Secretary to the commission, without extra compensation, and shall keep an accurate record of all proceedings of said commission, and shall file, when ordered by the commission, with the Council, a report of all transactions of the Planning and Zoning Commission. 2-4-3: Membership; Appointment; Terms; Vacancies


The Planning and Zoning Commission shall consist of the Mayor and one person who is, at the time of initial appointment, under eighteen (18) years of age, as nonvoting ex officio members and, in addition thereto, not less than seven (7) nor more than eleven (11) additional voting members, to be appointed by the Mayor and confirmed by the Council. Persons living within the area of City impact shall be entitled to representation on the Planning and Zoning Commission. Such representation shall as nearly as possible reflect the proportion of population living within the area of impact. The term for each appointment shall be four (4) years. No person shall serve more than two (2) full consecutive terms without specific concurrence by two-thirds (2/3) of the City Council adopted by motion and recorded in the minutes. If a vacancy shall occur during any unexpired term, the Mayor, with the confirmation of the Council, shall appoint a member for the balance of such unexpired term. (Ord. 4-15, 2-10-2015)

2-4-4: Chairperson


The Planning and Zoning Commission shall meet and appoint one of its members as Chairperson of the commission, who shall hold office as such Chairperson for such term as the commission shall so designate, and the commission may elect a Co-Chairperson, who shall act as Chairperson in the absence of the Chairperson of the commission. 2-4-5: Compensation; Quorum


A. Compensation; Expenses: The members of the Planning and Zoning Commission shall serve and act without compensation, except that their actual and necessary expenses shall be allowed by the Council and the City shall provide the necessary and suitable equipment and supplies to enable the commission to properly transact and perform its business.


B. Quorum: A majority of the appointive members of the commission shall be necessary to constitute a quorum for the transaction of business. The commission shall hold meetings each month for at least nine (9) months of the year, and at such other times as may be called by the Chairperson or by the Mayor. (1952 Code § 2-06-05)

2-4-6: Duties


It shall be the duty of the Planning and Zoning Commission to study and examine the economic, social and physical conditions and problems of the City, particularly in regard to and in connection with regulations for the development of all public enterprises within the City, and to recommend and make suggestions to the Mayor and Council in regard to public development, operation, management, regulation and control of all public utilities, buildings, property and structures and to recommend and propose all measures and plans consistent with the future growth and development of the City in order to secure for the City and its inhabitants proper sanitation and the establishment and promotion of proper service of all public utilities and facilities and to promote such measures as may be advisable and beneficial for the promotion of the public health, interest, morals, safety, comfort and welfare of the inhabitants of the City. 2-4-7: Cooperation Of City Departments


This chapter shall not be construed in any manner as infringing upon any authorization previously granted to any other commission or board of the City, but all the departments and officials of the City shall cooperate with the Planning and Zoning Commission for the purpose of coordinating the efforts and functions of all departments, commissions and boards of the City for the development of all public facilities of the City.
